MnK Niseko Terms & Conditions

These terms and conditions apply to any booking you make with us in person, via phone or electronic communication. These terms also apply to all travellers in your booking and to any guest services booked for individuals in the group.

Enquiries & Quotes

All enquiries and reservations for properties managed by MnK can be made by email to bookings@mnkniseko.com or via telephone on +81 (0)136 55 5122. All quotes for accommodation and services are valid for 7 days from time of issue and subject to availability. Services quotes are based on prices supplied by our preferred agents, having been vetted by MnK to meet our service standards.

Reserving with a third party/agent

All guests who choose to reserve their stay via online travel agents (Booking.com, Expedia etc) or other third-party travel partners should contact their booking provider for information on their applicable reservations policies.

Confirmation and Securing a Booking

Until acknowledged in writing by MnK and/or payment is received for an accommodation booking, the status of the booking is not confirmed. Accommodation may be ‘held’ for a customer for a period of 7 days until which time it will be cancelled unless payment has been received. By making any payment towards accommodation bookings you acknowledge and accept our booking terms and conditions.

Prices

All prices are subject to availability and can be withdrawn or updated without notice. The price is only guaranteed when paid in full. Please note that prices quoted are subject to change. Price changes may occur due to reasons outside of our control that increase the cost of the product or service. Such factors include, but are not limited to: cost of cleaning, heating or snow clearing.

Additional Guests

Each house can accommodate up to a certain number of people. Please kindly inform us of the total number of guests including small children before you proceed with the booking. In the event that at any time during your booking period, the number of guests staying at the property under your reservation exceeds the number disclosed by MnK, you will be charged an additional 100% of the nightly rental fee for each additional undisclosed guest. If the undisclosed guest/s exceeds the maximum capacity of the property, and we cannot accommodate extra persons, MnK has the right to immediately cancel your booking without refund.

Modifications or Cancellations by MnK

While highly unlikely, MnK and/or its agents reserve the right to change, modify or cancel a reservation or arrangement at any time. Should payment have been made, this will be refunded to the guest in full. MnK and/or its agents also reserve the right to decline a reservation at any time.

Winter
Policies for reservations falling between 1 December - 28 April
Winter 21/22 Reservations
Payment Policy
  • A 20% deposit must be received within 7 days of making the reservation
  • All reservations must be paid in full 60 days prior to arrival, unless otherwise specified in writing
  • Reservations made within 59 days of arrival must be paid in full within 7 days from booking
  • If the booking is made 7 days or less from check in date, full balance payment must be received within 48 hours of making the booking
  • Payments must be in Japanese yen via bank transfer, credit card, PayPal, Flywire or cash
  • Bank transfer is not available for bookings made within 7 days of arrival

For payments made via credit card, any credit card fees incurred will be covered by the guest.
For payments made via bank transfer, any fees charged by both the sending bank and the receiving bank will be covered by the guest.

Winter 22/23: Standard Reservations

Your reservation is considered a 'standard reservation' if you did not book with our Early Bird offer or make a reservation using a pre-existing credit from Winter 18/19, Winter 19/20, Winter 20/21 or Winter 21/22.

Payment Policy
  • A 20% deposit must be received within 7 days of making the reservation
  • All reservations must be paid in full 60 days prior to arrival, unless otherwise specified in writing
  • Reservations made within 59 days of arrival must be paid in full within 7 days from booking
  • If the booking is made 7 days or less from check in date, full balance payment must be received within 48 hours of making the booking
  • Payments must be in Japanese yen via bank transfer, credit card, PayPal, Flywire or cash and are non refundable
  • Bank transfer is not available for bookings made within 7 days of arrival

For payments made via credit card, any credit card fees incurred will be covered by the guest.
For payments made via bank transfer, any fees charged by both the sending bank and the receiving bank will be covered by the guest.

Winter 22/23: Early Bird Reservations

Your reservation is considered an 'Early Bird Reservation' if you reserved with our Early Bird rate before July 1st, 2022.

Payment Policy
  • A 20% deposit must be received within 7 days of making the reservation
  • All reservations must be paid in full 60 days prior to arrival, unless otherwise specified in writing
  • Payments must be in Japanese yen via bank transfer, credit card, PayPal, Flywire or cash and are non refundable

For payments made via credit card, any credit card fees incurred will be covered by the guest.
For payments made via bank transfer, any fees charged by both the sending bank and the receiving bank will be covered by the guest.

Winter 22/23: Reservations by Guests with Existing Credits

These terms and conditions apply to credit holders from reservations originally held in Winter 19/20, Winter 20/21 or Winter 21/22. These guests can re-book their stay for Winter 2022-23. Reservations using an existing credit must be secured by April 28th, 2023. Credit that is unused after this date will be forfeited. If a reservation has a balance that is greater than the value of an existing credit, the difference must be paid according to the payment policy detailed below.

Summer

Standard Reservations

General Policy on Cancellations

Cancelled bookings may incur charges, MnK reserves the right to uphold cancellation charges where applicable. These charges can be up to 100% of the cost of the booking, regardless of whether stay has commenced. Fees and extra charges may apply where a booking is changed. Where MnK incurs any liability for a cancellation fee or charge for any booking which you cancel or change, you agree to indemnify us for the amount of that fee or charge. This applies to fees set by internal or external service providers. You will be required to pay a deposit or the full amount for the reservation when booking.

Cancellations by Guests who reserved through an agent

All guests who booked via online travel agents (Booking.com, Expedia etc) or other third-party travel partners should contact their booking provider for information on their applicable cancellation policy.

Refund Transaction Fees

Please note the following policy for instances where a refund is granted:

  • Bank Transfer: Fees that may be charged by both the Sending and Receiving bank will be covered by the guest.
  • Credit Card/Pay Pal: Any transaction fees that may be charged during the refund process will be covered by the guest.
  • Exchange Rates: All refunds will be issued in JPY and are subject to exchange rate conversion rates at the time of transaction.
Insurance

Please ensure you take out travel insurance at time of booking to cover any unforeseen circumstances that may result in cancellation.

Winter
Policies for reservations falling between 1 December - 28 April
Winter 21/22 Reservations
Cancellation Policy
  • Any cancellation made before 30 days prior to arrival will not incur a cancellation fee.
  • Any cancellation made after 29 days prior to arrival date will incur 100% cancellation fees.
Amendment Policy
  • Changes to a reservation such as a property change, date change or party size change are not confirmed until sent in writing by MnK.
  • Changes to a reservation resulting in the reduction of nights or properties is treated as a cancellation and is subject to the cancellation policy detailed in the 'Cancellations' tab.
  • A date change can be only be made to a reservation if the new date falls within the same season (Winter: December to April, Summer: May to November) as the original reservation. Requests to move reservations to a different season may not be accepted. Fees may apply.
Winter 22/23: Standard Reservations

  • A date change can be only be made to a reservation if the new date falls within the same season (Winter: December to April, Summer: May to November) as the original reservation. Requests to move reservations to a different season may not be accepted. Fees may apply.
Winter 22/23: Reservations by Guests with Existing Credits

These terms and conditions apply to credit holders from reservations originally held in Winter 19/20, Winter 20/21 or Winter 21/22. These guests can re-book their stay for Winter 2022-23. Reservations using an existing credit must be secured by April 28th, 2023. Credit that is unused after this date will be forfeited.

Cancellation Policy
  • Any cancellation made before or on the final payment due date will incur a cancellation fee of the total deposit amount (or, for credit holders, the total value of your held credit with MnK). This amount is non-refundable.
  • Any cancellation made after the final payment due date will incur a cancellation fee of 100% of the total accommodation amount (or, for credit holders, the total value of your held credit with MnK plus any additional funds you may have paid). This amount is non-refundable.
Amendment Policy
  • Changes to a reservation such as a property change, date change or party size change made before August 1st, 2022 can be accepted free of charge.
  • Changes made after July 31st, 2022 are treated as a cancellation and are subject to the appropriate cancellation policy.
  • Changes to a reservation are not confirmed until sent in writing by MnK.
  • A date change can be only be made to a reservation if the new date falls within the same season (Winter: December to April, Summer: May to November) as the original reservation. Requests to move reservations to a different season may not be accepted. Fees may apply.

Cancellation Policy for all other Services in Winter
  • Cancellations made on or before 15 days prior to the activity start date will incur no penalties except an administration fee.
  • Cancellations made on or within 14 days prior to the activity start date will incur a 100% cancellation fee.
  • Specific services may enforce a different cancellation policy, which is subject to the external service provider's discretion. MnK will provide written information on any differing cancellation policies for your chosen service/s prior to confirmation.
Summer
Policies for reservations falling between 29 April - 30 November
Reservations of 1-3 Nights
Cancellation Policy
  • Cancellations made on or before 3 days prior to the arrival date will incur no penalty.
  • Cancellations made on or within 2 days prior to the arrival date are subject to a cancellation fee of 100% of the total accommodation fee.
Amendment Policy
  • Changes to a reservation such as a property change, date change or party size change are not confirmed until sent in writing by MnK.
  • Changes to a reservation resulting in the reduction of nights or properties is treated as a cancellation and is subject to the cancellation policy detailed in the 'Cancellations' tab.
  • A date change can be only be made to a reservation if the new date falls within the same season (Winter: December to April, Summer: May to November) as the original reservation. Requests to move reservations to a different season may not be accepted. Fees may apply.
Reservations of 4-20 Nights
Cancellation Policy
  • Cancellations made on or before 15 days prior to the arrival date will incur no penalty.
  • Cancellations made between14-4 days prior to the arrival date are subject to a cancellation fee of 50% of the total accommodation fee.
  • Cancellations made on or within 3 days prior to the arrival date are subject to a cancellation fee of 100% of the total accommodation fee.
Amendment Policy
  • Changes to a reservation such as a property change, date change or party size change are not confirmed until sent in writing by MnK.
  • Changes to a reservation resulting in the reduction of nights or properties is treated as a cancellation and is subject to the cancellation policy detailed in the 'Cancellations' tab.
  • A date change can be only be made to a reservation if the new date falls within the same season (Winter: December to April, Summer: May to November) as the original reservation. Requests to move reservations to a different season may not be accepted. Fees may apply.

  • Cancellations made on or within 7 days prior to the activity start date will incur a 100% cancellation fee.
  • Specific services may enforce a different cancellation policy, which is subject to the external service provider's discretion. MnK will provide written information on any differing cancellation policies for your chosen service/s prior to confirmation.
Property Damage

The guest in any MnK property shall pay in full for any damage outside normal wear and tear. This includes breakage to items such as plates, glasses or lamps. MnK will do an inspection of the property upon check out, however, any breakage or damage must be reported to staff as soon as possible.

Lost or Missing Keys

Lost or missing keys will result in a penalty of ¥15,000 per key.

No Smoking Policy

All MnK properties maintain a strict no smoking policy within the building. Should any guest or lessee be found violating this policy, an immediate ¥80,000 fine will be imposed and management reserves the right to evict the guest or lessee without notice or refund.

Pets

All MnK properties hold a no pets policy. As such, any guest or lessee found to be holding a pet inside a property will be fined and management reserves the right to evict the guest or lessee without notice or refund.

Property and Resort Guidelines

To ensure a safety and enjoyment of all guests at properties and resorts managed by MnK, rules and regulations have been established. These rules will be explained to guests upon check-in and are available upon request. Any guest who violates these rules or negatively impacts upon the enjoyment of other guests, may be fined and management reserves the right to evict the guest or lessee without notice or refund.

Travel Insurance

MnK strongly advises that all guests purchase comprehensive travel insurance to cover themselves against medical expenses, personal accident, damage and loss of luggage, cancellation fees, etc.

Transportation Liability

MnK may include transfers to and from Niseko in its packages. Third party transport operators provide this transportation. MnK accepts no responsibility for any delays, accidents or incidents that affect our customers. No refunds of accommodation costs or any other related services will be given if the customers are unable to arrive on the day of predetermined booking including travel being impaired by weather conditions and likewise MnK and/or its agents will not be responsible for providing additional accommodation in the event customers are prevented from leaving Niseko – Hirafu due to unforeseen circumstances including weather.

Weather

MnK cannot be held responsible for weather conditions. No accommodation booking can be refunded on the basis of weather conditions.

Passports, Visas and Entry

Guests are responsible for arranging any necessary passports and visas. Japanese visa requirements vary greatly for individual countries. Contact the Japanese consulate in your country for more information.

Limited Liability

You and your booking party hereby acknowledge and agree that you and your guests:

  • Are solely responsible for your safety and the safety of your belongings during your stay at a MnK managed property; and
  • Shall, except where prohibited by law, fully indemnify and hold harmless the MnK and any of its group companies and the officers, directors, employees, shareholders or agents of any of them and the owner of the property reserved for or occupied by you and your booking party, or any of the owner’s group companies and the officers, directors, employees, shareholders or agents of any of them, against any and all liability and responsibility for any physical accident, injury or harm and proprietary loss or damage of whatsoever nature and extent that may result to you or any member within your booking party or a third party in connection with or as a result of your stay at a MnK managed property, whether resulting from any act or omission by any staff member of MnK or from the use of the shuttle bus or any of the other services, equipment and facilities provided, and whether in the property or other buildings or within or without the grounds of The Chalets at Country Resort, Akazora or The Orchards.

This indemnity includes:

  • Any physical or financial damage or harm and any loss or property that is left in the aforesaid property or on or about the grounds of The Chalets at Country Resort, Akazora or The Orchards or in any vehicles or transport provided by MnK; and
  • Any business or economic loss and indirect or consequential loss such as lost reputation, lost bargain, lost profit, loss of anticipated savings or lost opportunity which may be suffered by you or any member of your booking party. Neither MnK nor the owner of the chalet reserved for or occupied by you and your booking party shall be liable for any noise, nuisance or inconvenience suffered as a result of any construction or similar work being carried out. The total liability of MnK and the owner of the chalet shall in all cases, whether in in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise shall be limited to the price paid by you for your accommodation during the relevant stay.
Guest Registration Form

At their arrival the guests will be required to fill out and sign a guest registration form. By signing this form, you, as the nominated guest responsible for your reservation, irrevocably authorise MnK to deduct any outstanding accommodation charges, vehicle transfers, ski rental, lift passes, ski school reservations and any additional services arranged through Midori no Ki (“MnK”), in good faith, on your behalf; and you accept financial responsibility for all charges incurred by or on behalf of those guests whose contact and passport details are contained in this reservation (“your booking party”). Any cancellations made outside of the conditions specified in our cancellation policy will attract a 100% charge for services.

Additional charges may be imposed on you for damage to any property caused by you or any member of your booking party: in particular, any damage to the property reserved for or occupied by you or your booking party, any loss of or damage to the contents thereof, and any items which are found by MnK, either during or immediately after your stay, to have been removed from the chalet. MnK will notify you via email or phone of such loss and/or damage, and will charge you for the lost and damaged property and/or items on a replacement cost basis plus any necessary and incidental expense incurred in the repair and/or replacement thereof. You and the members of your booking party hereby agree that you and they shall comply with the terms and conditions of this registration form and all other rules relating to guests’ stay at any MnK managed property as set out on our website www.mnkniseko.com and other manuals, and that MnK is the managing agent for the property which has been booked in your name, or which you and your booking party occupy.

Be advised that weather and snow conditions can be hazardous and as such all guests must be prepared for the prevailing environment. Build-up of snow on roofs, ice on roads, walkways and steps are dangerous and all guests are advised to be aware of the risks of falling snow loads and slippery surfaces.in the event that at any time during your booking period, the number of guests staying at the property under your reservation exceeds the number disclosed to MnK you will be charged an additional 100% of the nightly rental charge for each additional undisclosed guest. If the undisclosed guests exceed the maximum capacity of the property and we cannot accommodate them, MnK may immediately cancel your reservation without refund.
